      <description>Reverend Lynn and Mr. Sekulow talked about the separation of church and state issues before the Supreme Court this term and John Roberts' views on these issues. The Court will hear a case this fall on a church's religious freedom claim to use hallucinogenic tea in its services. While at the Justice Department, John Roberts helped draft arguments urging the Supreme Court to allow public school-sponsored prayer at graduation ceremonies. The Reverend Lynn opposed the Roberts nomination to the U.S. Supreme Court and Mr. Sekulow supported him due to Roberts' view on church and state issues. They also responded to questions and comments from viewers.

On March 2nd, the Supreme Court had scheduled oral arguments in two cases that concerned the placement of Ten Commandment displays on public property.       <title>America and the Courts</title>
      <description>America and the Courts featured three events:
 
 1. On December 2, attorney Jay Sekulow and his client Joshua Davey, defendant in [Locke v. Davey] talked with reporters outside the U.S. Supreme Court building following oral arguments in the case. In the case Joshua Davey sued the state of Washington for denying him a scholarship, to which he otherwise would have been entitled, if not for his decision to pursue a degree in theology. At issue was whether or not a Washington state constitutional ban on the use of public money for religious purposes had resulted in a violation of Mr. Davey's First Amendment right to freely exercise his religion. Judge Starr told reporters that he had filed an [amicus] plea on behalf of Joshua Davey. On the other side of [Locke v. Davey], Solicitor General Pierce, Mr. Lynn, Mr. Diament, and Mr. Mincberg talked about the separation of church and state argument.
 
 
 2. On December 3, Allan Favish spoke with reporters following oral arguments in his case, [Office of Independent Counsel v. Favish], in which Mr. Favish had filed for the release of death scene photos of former deputy White House counsel Vincent Foster under the Freedom of Information Act. At issue was whether or the rights of Mr. Favish and the public under the FOIA would supersede the privacy rights of Foster's survivors, or vice versa.
 
 3. On December 5, members of the U.S. Supreme Court posed for a formal group photograph. Video clips were also shown of each justice during the photo session. The last group photo was in 1994 when Justice Breyer joined the Court. This year's photo may mark the first time the justices posed for an official group photograph without a change in membership.</description>

      <description>An audio record of oral arguments from earlier in the day in a case over campaign finance reform legislation were played over still images of the participants.
 
 Arguments focused on limits to unregulated, or "soft money," campaign contributions, new restrictions on some forms of campaign advertising, and campaign contributions by minors.
 
 This hearing took place in an unusual session prior to the normal Supreme Court term and lasted four hours. It also was only the third time audio of a hearing had been released on the day of the oral arguments.</description>

Mr. Sekulow talked about the conflict between religious concerns and some people's interpretations of the law. Ms. Schafley and the Christian Coaltion's attempts to influence the Republican party, especially on the abortion issue. Mr. Barton talked about how  biblical foundation can ensure that a government retains its righteous character. Mr. Bozell, Mr. Williams and Mr. Liddy talked about the heightened impact of talk radio on American politics. Mr. Cunningham and Mr. Gribbon spoke about the importance of the upcoming mid-term elections.</description>

The bill would set up penalties of up to three years in prison and a $250,000 fine for illegal blockading of abortion clinics. Witnesses at the hearing included doctors, patients, administrators, and anti-abortion protesters.</description>

The case followed Operation Rescue's siege of abortion clinics in Wichita, Kansas for months in the summer of 1991.</description>

      <title>Case Discussion</title>
      <description>Mr. Mauro discussed four recent decisions and a case currently being heard by the Court. The Court ruled 5-4 in [Spallone v. U.S.] that a federal judge had exceeded his authority by ordering desegregation legislation in Yonkers, New York and then fining city councilmen when they failed to pass the legislation. In the case of [James v. Illinois], also a 5-4 decision, the Court declined the opportunity to expand the "Exclusionary Rule," which limits the admissibility of evidence obtained illegally. In [University of Pennsylvania v. EEOC], the justices decided unanimously that colleges have no special privilege to withhold confidential information. The Court ruled 6-3 in the case of [FW/PBS Enterprises v. Dallas] that the Constitution's guarantee of free speech was violated by the city's attempt to regulate adult book stores through a licensing ordinance. Finally, in [Tyler v. Berodt], the Court let stand a lower court ruling that granted no right to privacy when using a cordless phone. Also shown were interviews outside the Court with the litigants in [Board of Education v. Mergens], a case concerning the right of religious clubs to use public school facilities. A panel discussion with Mr. Woodruff and Mr. Minceberg focused on the social and legal impacts of this case.</description>
